Companies in the UK must now include certain regulatory information on their websites and in their email footers or they will breach the Companies Act and risk a fine. A statutory instrument was published on 20 December, which amended the Companies Act 1985. The instrument took effect on 1 January so, unfortunately, it is therefore possible that you are already in breach of it. If you are not responsible for making changes to your website or emails, please pass it to a colleague who is as soon as possible. The result for non-compliance is now subject to a penalty of £1000.

Every company should list its company registration number, place of registration, registered office address and VAT number (if applicable) on its website as a result of an update to the legislation of 1985. The information, which must be in legible characters, should also appear on order forms and in emails. Such information is already required on 'business letters' but the duty is being extended to websites, order forms and electronic documents.

If you are a limited company, you will need to ensure that you have published the required information on all your websites.  We will keep you informed of any further changes to the Companies Act.
